Terms of Service

These are the terms under which Warp Valley Inc. offers AX Rush. They are written to be read; the short version is that we measure what your site already publishes, you stay the owner of what is yours, and a subscription renews until you cancel it.
1. Agreement
These terms are a contract between you and Warp Valley Inc. (“Warp Valley”, “we”, “us”) governing the AX Rush service at axrush.com. By using the service you accept them. If you use the service on behalf of an organization, you represent that you can bind that organization, and “you” includes it.
2. The service
AX Rush measures how ready publicly accessible websites are for AI agents: scores against weighted checks, reports, monitoring over time, scheduled scans, alerts, generated files such as llms.txt, and programmatic access through the documented API, MCP and A2A endpoints. The service evolves; features may be added, changed or retired.
3. Accounts
Keep your account information accurate and your credentials to yourself; you are responsible for what happens under your account. An organization’s owners control its membership and what members can do.
4. Subscriptions and billing
Paid plans are subscriptions. They are billed in advance, on a recurring basis for the interval you choose, and renew automatically until cancelled. Payments are processed by Stripe.
- You may cancel at any time. Cancellation takes effect at the end of the period already paid for, and you keep access until then.
- Amounts already paid are not refunded for partial periods, except where the law requires otherwise.
- Price changes are announced at least 30 days in advance and apply from your next renewal, never retroactively.
- Prices may not include taxes; where tax applies, it is added at the rate the law sets.
- If a renewal payment fails and retries fail with it, paid features may be suspended until payment succeeds.
We may offer free features or trials, and may change their limits with notice.
5. Limits and fair use
Scans, API calls and metered features are subject to the limits of your plan and to rate limits that protect both the service and the sites being measured. We may throttle usage that threatens either.
6. Scanning websites
The scanner fetches only what is publicly reachable, with a small, bounded number of plain HTTP requests: no credentialed areas, no circumvention of access controls. You must not use the service to overload, probe or attack any site, or to attempt access beyond what its operator has published.
You may measure domains you do not own precisely because measurement is limited to what any visitor could fetch. What you do with the results is your responsibility.
7. Public reports
Scans submitted through the anonymous public scanner produce reports at stable public URLs, and those reports may be indexed. If you operate a website and want its public report removed, write to info@axrush.com.
8. Acceptable use
You must not:
- use the service to break the law, or to infringe anyone’s rights
- interfere with or disrupt the service, or access it other than through its documented interfaces
- resell or repackage the service without a written agreement with us
- misrepresent your affiliation with any site you scan
- abuse features backed by AI models, including attempts to extract or manipulate them
9. Your content
You keep every right you have in the domains, settings and content you submit. You grant us the license needed to operate the service on them: to fetch, process, store and display them in your reports, history and generated files. We claim nothing else.
10. Generated files
Files the service generates (llms.txt and its relatives) are derived from what your site already publishes. Where a value could not be read from your site, the generator does not invent one, and neither should you. Review generated files before publishing them; once published on your site, they are yours.
11. Our intellectual property
The service, its software, its scoring and its brand belong to Warp Valley. These terms give you the right to use the service, not to copy it. If you send us feedback, we may use it without obligation.
12. Disclaimers
The service is provided “as is” and “as available”. Scores and findings are automated measurements of a site at a point in time, not guarantees: we do not promise that any AI system will read, describe, rank or recommend your site in any particular way, and nothing here is legal or professional advice. To the maximum extent the law allows, we disclaim all implied warranties.
13. Limitation of liability
To the maximum extent the law allows: we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data; and our total liability for all claims together is capped at the greater of the amounts you paid us in the twelve months before the claim and 100 U.S. dollars. Some jurisdictions do not allow some of these limits; where that is so, they apply to the extent permitted.
14. Indemnity
You will defend and indemnify Warp Valley against claims arising from your breach of these terms or your misuse of the service.
15. Termination
You may close your account at any time. We may suspend or terminate access for breach of these terms or to protect the service or the sites it measures, with notice where practicable. On closure, your data is handled as the Privacy Policy describes. Sections that by their nature survive (payment obligations, disclaimers, limitation of liability, disputes) survive.
16. Changes to these terms
When these terms change, the new version is published here with its date. If a change materially reduces your rights, we will email account holders at least 30 days before it takes effect. Using the service after that date means you accept the change.
17. Governing law and disputes
These terms are governed by the laws of the State of Florida, United States, excluding its conflict-of-law rules. Disputes are resolved exclusively in the state or federal courts located in Florida, and both sides consent to their jurisdiction.
